1. Acceptance of Terms

By accessing or using NeedInstall.com ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

NeedInstall is a directory service that connects customers with local installation professionals. We provide a platform for contractors to list their services and for customers to find and contact them.

3. Contractor Listings

3.1 Listing Tiers

• Verified Pro ($50 USD/month): Enhanced listing with Verified Pro badge, prominent placement, and quote requests.
• Top Spots (sealed bid): Up to 3 featured positions awarded to the highest bidders monthly.

3.2 Sealed Bid Auction

The Top Spots positions in each city/category are determined by a sealed-bid auction:

• Contractors set a maximum monthly bid (minimum $65 USD)
• All bids are sealed and confidential — no contractor sees another's bid
• Positions are recalculated on the 25th of each month
• The top 3 highest bidders win Top Spots and are charged their bid amount
• Non-winning bidders remain at their Verified Pro tier at the flat rate
• Bid amounts are never disclosed to other contractors

3.3 No Guarantee of Leads

NeedInstall does not guarantee any specific number of leads, customers, or revenue. Listing visibility and position are determined by tier and bid amount, not by actual customer engagement.

4. Billing and Cancellation

• All subscriptions are billed monthly in advance
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial months
• Bid changes take effect on the 25th of the following month
• You may adjust your bid at any time; changes apply next month

5. Contractor Responsibilities

Contractors agree to:

• Provide accurate business information
• Maintain appropriate licenses and insurance for their services
• Respond professionally to customer inquiries
• Not misrepresent their qualifications or experience
• Comply with all applicable laws and regulations

6. No Endorsement

NeedInstall does not vet, endorse, or guarantee the quality of any contractor listed on the platform. "Featured" and "Verified Pro" badges indicate that a contractor has claimed and paid for their listing — they do not represent an endorsement of work quality, reliability, or trustworthiness.

Customers are responsible for verifying contractor credentials, checking references, and making their own informed decisions.

7. Limitation of Liability

NeedInstall is a directory and connection service only. We are not a party to any agreement between contractors and customers. We are not responsible for:

• The quality of work performed by contractors
• Disputes between contractors and customers
• Any damages, injuries, or losses arising from services provided by contractors
• The accuracy of information provided by contractors

To the maximum extent permitted by law, NeedInstall shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

8. Intellectual Property

All content on NeedInstall, including but not limited to text, graphics, logos, and software, is the property of NeedInstall or its licensors and is protected by intellectual property laws.

9. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the new terms.
